1. Agreement to Terms

By accessing or using ClaimMySpot ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

ClaimMySpot provides a platform connecting parking space providers ("Organizations") with individuals seeking parking ("Customers"). These Terms apply to all users of the Service.

2. User Accounts

Account Creation:

  • You must provide accurate, complete, and current information during registration
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 18 years old to create an account
  • One person or entity may not maintain more than one account

Account Responsibilities:

  • You are responsible for all activity that occurs under your account
  • Notify us immediately of any unauthorized use of your account
  • We reserve the right to suspend or terminate accounts that violate these Terms

3. For Customers (Parking Seekers)

Booking and Payment:

  • All bookings are subject to availability and confirmation
  • Payment is due at the time of booking through our payment processor (Stripe)
  • Prices are set by individual Organizations and may vary
  • You agree to pay all fees and charges incurred under your account

Cancellations and Refunds:

  • Cancellation policies are set by individual Organizations
  • Refunds, if applicable, are subject to the Organization's cancellation policy
  • ClaimMySpot acts as a platform and is not responsible for refund disputes

Vehicle Information:

  • You must provide accurate vehicle information when booking
  • The vehicle parked must match the booking details
  • You are responsible for any damage caused by your vehicle

QR Codes and Access:

  • QR codes are for your exclusive use and may not be shared or transferred
  • You must present valid QR code for access to parking locations
  • Lost or stolen QR codes should be reported immediately

4. For Organizations (Parking Providers)

Listing Requirements:

  • You must have legal authority to list and operate parking spaces
  • All location information must be accurate and up-to-date
  • Photos must accurately represent the parking facility
  • You must honor all confirmed bookings

Pricing and Fees:

  • You set your own pricing for parking services
  • ClaimMySpot may charge service fees or commissions on bookings
  • Payments are processed through Stripe and subject to their terms
  • Price changes do not affect existing bookings

Responsibilities:

  • Maintain safe and accessible parking facilities
  • Comply with all local laws and regulations
  • Provide accurate availability information
  • Honor confirmed bookings or provide prompt refunds
  • Not discriminate against customers based on protected characteristics

Liability:

  • You are responsible for the security of vehicles parked at your location
  • You must maintain appropriate insurance coverage
  • You are liable for any damages or losses at your facility

5. Prohibited Conduct

You agree not to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit malware, viruses, or harmful code
  • Harass, abuse, or harm other users
  • Impersonate any person or entity
  • Collect user information without consent
  • Use automated systems to access the Service
  • Attempt to gain unauthorized access to our systems
  • Post false, misleading, or fraudulent content

6. Intellectual Property

The Service and its original content, features, and functionality are owned by ClaimMySpot and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of content you submit, but grant ClaimMySpot a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content in connection with the Service.

7. Payment Processing

All payments are processed through Stripe, a third-party payment processor. By using our Service, you agree to Stripe's Terms of Service and Privacy Policy.

ClaimMySpot does not store credit card information on our servers. All payment data is handled securely by Stripe in compliance with PCI DSS standards.

8. Limitation of Liability

ClaimMySpot acts solely as a platform connecting parking providers with customers. We are not responsible for:

  • The condition, safety, or legality of parking locations
  • Vehicle damage, theft, or loss at parking facilities
  • Actions or omissions of Organizations or Customers
  • Disputes between Organizations and Customers
  • Service interruptions or technical issues

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLAIMMYSPOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

9. Indemnification

You agree to indemnify, defend, and hold harmless ClaimMySpot and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your content or conduct on the platform

10. Dispute Resolution

Between Users:

Disputes between Customers and Organizations should be resolved directly between the parties. ClaimMySpot may provide assistance but is not obligated to mediate disputes.

With ClaimMySpot:

Any disputes with ClaimMySpot shall be governed by the laws of the State of New York, without regard to conflict of law provisions. You agree to submit to the exclusive jurisdiction of courts located in New York, NY.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last Updated" date.

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
